Removal Defense for Your Immigration Court Case

A court notice can leave you unsure about your future, your family, and what to do next. Removal defense starts with understanding why the government seeks your removal and which legal options may apply.

LOIGICA helps you review your immigration history, understand the issues in your case, and prepare for the next stage. Tell us if you have a hearing, a filing deadline, or an existing removal order.

What removal defense involves

Removal defense, often called deportation defense, addresses the government’s effort to remove someone from the United States. It can involve challenging the allegations or legal charges and applying for relief when the person qualifies.

A Notice to Appear explains the government’s allegations and charges. In regular removal proceedings, the case begins when DHS files that notice with the immigration court after serving it. The notice itself is not a final removal order.

Different procedures can apply at the border or after a prior removal. We first identify the type of proceeding so the strategy matches your situation.

Received a notice or hearing date

Keep every page of your notice and any envelope that came with it. Check the hearing instructions and keep your contact information current with the court. Do not assume a hearing has changed because you requested a different date.

Missing a required hearing can lead to a removal order in your absence. If you already missed one, seek prompt advice about the existing order and any available response.

How LOIGICA can help

The first review should clarify what the government alleges, what has already happened, and what needs attention now. Depending on your case and the agreed representation, our work may include:

01 Reviewing notices, prior applications, decisions, and relevant immigration records.
02 Assessing possible defenses and eligibility for relief.
03 Preparing applications, supporting evidence, and legal arguments.
04 Helping you prepare truthful testimony and understand hearing procedures.
05 Providing immigration court representation within the agreed scope.

If someone else prepared an earlier filing, share a complete copy. Tell us about errors, missing information, or documents you do not understand. Reviewing the actual record helps us identify issues before deciding how to address them.

Possible options in removal proceedings

Your entry history, immigration status, family relationships, and any criminal record can affect the available options. No single application fits every case. The review may include the following issues.

Challenging the government’s case

An attorney can examine whether the allegations and charges support removal under the applicable law. This review comes before assuming that you must qualify for a particular benefit to defend your case.

Asylum and related protection

If you fear persecution or torture in another country, protection claims may require assessment. Asylum, withholding of removal, and protection under the Convention Against Torture have different requirements and consequences. Our Asylum page explains that service in more detail.

Cancellation of removal

Cancellation of removal has separate eligibility rules for certain permanent and nonpermanent residents. For the usual nonpermanent resident category, the requirements include ten years of continuous physical presence and good moral character. Certain convictions can disqualify an applicant. *

Other possible relief

Depending on your record, other possibilities may include adjustment of status or an applicable waiver. The available procedure and the authority to decide the request matter. A family relationship or pending petition alone does not resolve the removal case.

Preparing for the next

Preparing for the next stage

A master calendar hearing generally addresses the charges, potential applications, and scheduling. An individual hearing may involve evidence and testimony. We explain what the relevant stage requires and what you need to prepare.

Useful records for a case review may include:

✓ Your Notice to Appear, hearing notices, and any court decisions.
✓ Passports, entry records, and copies of earlier immigration filings.
✓ Relevant family records and evidence of residence.
✓ Complete records of arrests or criminal cases, including their outcomes.

You do not need to upload these materials through the public contact form. Start with your case stage and any upcoming date. We can then explain what information the review requires.

Frequently asked questions

Are removal defense and asylum the same service?

No. Removal defense concerns the broader court case. Asylum is one possible form of protection within that case for someone who qualifies. The appropriate defense depends on the person’s history and the applicable law.

Does hiring an attorney cancel my hearing?

No. Hiring counsel does not automatically change your hearing or excuse attendance. Follow the court’s instructions unless the court grants the relevant request. Do not treat a pending request as approval.

What if I already have a removal order?

Share the decision and its date promptly. An attorney must assess whether an appeal, motion, or other response is available. Deadlines and exceptions depend on the case. Filing a request does not always stop removal; a separate stay may be necessary.

Can you help if a family member is detained?

Tell us that the person is detained and identify the facility if you know it. Detention and possible release require a separate assessment. Availability of bond depends on legal and procedural factors; not everyone qualifies for a bond hearing.

How much do deportation defense services cost?

Fees depend on the stage, existing record, legal issues, and work involved. We explain the proposed representation and legal fees before an engagement begins. Ask whether the quote includes hearings, applications, and any additional proceedings.

How long will the case take?

There is no single reliable timeline. The court’s schedule, the type of proceeding, and developments in your case can affect timing. Continue tracking notices and deadlines while waiting for the next hearing.
